Case against Hulhumale’ Magistrate Court

On 20 February 2022, the Judicial Service Commission (JSC) had issued a statement in regard to the ongoing litigation case to dissolve the Hulhumale Magistrate Court. JSC states that the decision issued in the Supreme Court case of 2012/SC-S/31, which validates the establishment of the Hulhumale Magistrate Court is a major legal contradiction, as the Judicature Act states that K. Male’ will have Superior Courts, while any island outside of Male’ will have Magistrate Courts. The Constitution of Maldives establishes Hulhumale and Vilimale’ as districts of Male’, and not two administrative islands. Therefore, having a Magistrate Court in a district of Male’ contradicts the law. JSC also said that they will continue their efforts to dissolve the Hulhumale Magistrate court even if the Supreme Court had rejected their request to revise the above mentioned court order.
